Acceptance of Terms

By using Bottom Funnel's services, you agree to abide by these Terms and all applicable laws. Failure to comply may result in suspension or termination of services.

Scope of Services

As an App Development Provider (ADP), Bottom Funnel enables clients to create, manage, and share a variety of public, private, and commercial content. Meanwhile, clients are responsible for using these services ethically and legally.

Internet Use and Content Responsibility

The Internet is a global, decentralized network. While we ease access, we do not monitor or control the content accessed or shared. Clients must use discretion, especially with content that could be misleading, offensive, or inappropriate. We’re not responsible for any damages resulting from such content.

User-Generated Content

Clients are solely responsible for the content they publish through our services. This includes ensuring compliance with copyright, defamation, and content regulations. Misuse may impact other users and our business operations.

Prohibited Activities

You agree not to:

Send unsolicited commercial emails (spam).

Distribute viruses, malware, or engage in hacking.

Transmit defamatory, obscene, or illegal content.

Violate intellectual property rights.

Attempt unauthorized access to systems or data.

Abuse hosting resources, including bandwidth or storage.

Anti-Spam Policy

Bottom Funnel maintains a zero-tolerance policy toward spam. Clients found responsible for spam activities may be charged an investigation fee of $1000 (INR 70,000) and face suspension or termination of services.

Project Inactivity and Reallocation

Projects without client communication for over 7 days may be marked as inactive. Resources will be withdrawn after a 2-day notice. Moreover, reallocation of resources will incur a fee of 20-30% of the project cost.

Payment Terms

From January 2019 onward, payments are billed weekly or bi-monthly. Work begins only after invoice clearance. Further, the scope of work for each sprint is agreed upon in advance.

Copyright and Legal Compliance

Violations of copyrights or hosting of pirated software are strictly prohibited. Legal breaches can lead to civil/criminal consequences and account termination.

Hosting Restrictions

You may not host downloadable commercial software, patches, or electronic media. Sites found in violation will be removed without prior notice.

Hosting Environment and Liabilities

We operate as a reseller and rely on third-party data centres. While we strive to maintain uptime and performance, we’re not responsible for network outrages, server failures, or technical issues beyond our control. Clients are expected to maintain their own backups.

Domain Management

Clients are solely responsible for their domain name management, renewals, and accuracy of records. We act only as intermediaries in domain registrations through ICANN-authorized resellers.

Security and Data Access

Clients must protect their login credentials. We are not liable for breaches resulting from compromised access. While we respect privacy, we may disclose client information to comply with legal requirements.

Communication and Support

We provide basic technical support and strive to resolve client issues effectively. However, we do not offer support for issues arising from client-side coding errors or third-party plugins.

Disclaimer of Liability

We are not liable for service interruptions, data loss, or payment issues due to third-party services.

Only hard copies of invoices sent via Indian Postal Services are considered valid for official use.

Electronic invoices are for reference only.

Indemnity

Clients agree to indemnity Bottom Funnel against any legal crimes, damages, or losses resulting from violations of these Terms or applicable laws.

Policy Updates

We reserve the right to update these Terms at any time. Updated versions will be posted on our website.

Termination of Services

Violation of these terms may result in permanent closure without notice or refund. Also, we retain full discretion to enforce this policy.
